President and Fellows of Harvard College. Following the Harvard ruling, there have been litigation attacks on diversity-related initiatives, leaving employers wondering if their affinity group or hiring initiative will get them dragged into court.

“'It’s evolving before our very eyes. There are certain things that we're seeing more of, like reverse discrimination claims, and they're pointing to DEI programs as purported circumstantial evidence to support their discrimination claims,' Truong said. 'Because of that, DEI programs are being more scrutinized as a result. And we want to help [clients] set up their DEI programs to help fend off any meritless reverse discrimination claims if they do come up.'"
