Jean Pierre Nogues and Matthew Beasley Obtain Summary Judgment Win for Their Client
Jean Nogues and Matt Beasley obtained a summary judgment win on August 7, 2017 for approximately $1.5 million plus attorneys’ fees and costs against the primary debtor and two guarantors of a commercial loan. The defendants raised numerous defenses, including alleged oral modifications and agreements not to enforce. The Court found defendants’ arguments unpersuasive, particularly in face of integration clauses and provisions in the underlying documents requiring all modifications to be written.
Facing the imminent threat of having a public record of judgment against them as well as proceedings to execute on the judgment, the guarantors immediately settled with our client, and the client recovered a large percentage of the sums due within 30 days after the Court granted the summary judgment motion.
