The IP Implications of AI Model Training and Use
Many AI models use thousands or millions of copyrighted works as part of their “training.” We don’t know exactly how the courts will react and there are conflicting precedents. This session will discuss issues arising from the training and use of AI models, including arguments for and against the legality of using copyrighted material to train AI models. At the end of this session, participants will understand:

The primary copyright-based arguments made by different parties and the state of associated litigation

How Name, Image, and Likeness (NIL) laws might apply to creations “in the style of” existing artists

The implications of opt-in, opt-out, and “technological protection measures” as applied to publicly-posted materials

How to evaluate the IP-related legal and business risk from training and using AI tools
